• That any errors in the service will be corrected

SpamBarometer.com does not guarantee that emails tested through our service will be delivered to recipients' inboxes or that they will not be marked as spam by email providers. Email deliverability depends on numerous factors beyond our control, including recipient email provider policies, which may change without notice.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SPAMBAROMETER.COM AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS AND LICENSORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

IN NO EVENT SHALL SPAMBAROMETER.COM'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID TO SPAMBAROMETER.COM IN THE LAST SIX (6) MONTHS, OR, IF GREATER, ONE HUNDRED POUNDS (£100).

8. Indemnification

You agree to defend, indemnify and hold harmless SpamBarometer.com, its parent company, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from:

• Your use of and access to the service
• Your violation of any term of these Terms of Service
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right
• Any claim that content you submitted to the service resulted in damage to a third party
• Any activities conducted through your account, whether by you or by any other person accessing the service with your credentials

This defense and indemnification obligation will survive these Terms of Service and your use of the service.
